These Terms and Conditions ("Terms") govern your access to and use of divinemedicinals.com (the "Site") and any purchase you make through it.

The Site is operated by DDK Group, Inc., a corporation with its principal place of business at 8834 East 34 Road, STE 131, Cadillac, Michigan 49601, United States, trading as "Divine Medicinals Health Products" ("Divine Medicinals", "we", "us", "our"). By accessing the Site, creating an account, or placing an order, you agree to these Terms, our Refund Policy and our Privacy Policy, each of which is incorporated here by reference. If you do not agree, please do not use the Site or purchase from us.

1. Eligibility to Use the Site

You must be at least 18 years old and able to form a binding contract to use the Site or place an order. By ordering, you confirm that you are 18 or over and that any payment method you use belongs to you or that you are authorised to use it.

Our products are not intended for children. Where a product is formulated for children, it is intended to be purchased and administered by a parent or legal guardian, and the age guidance on the product page applies.

You are responsible for the accuracy of the information you give us, for keeping your account password confidential, and for all activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission.

We may suspend, restrict, or terminate your account or your access to the Site, in whole or in part, with or without notice, if we reasonably believe that you have breached these Terms, that your use of the Site is unlawful or harmful to us or to others, or that an order is fraudulent or unauthorised. We may also decline to do business with any person at our discretion, to the extent permitted by law. Suspension does not affect any order already accepted and paid for, which we will either fulfil or refund.

2. Products and Services

We sell herbal supplements, botanical extracts, teas, oils, creams, and related body care products.

These are dietary supplements and cosmetic products. They are not drugs or medical devices. Statements made about them on this Site have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Nothing on the Site is medical advice, and no content on the Site creates a practitioner and patient relationship between you and us.

Consult a qualified healthcare provider before using any product, in particular if you are pregnant, nursing, taking prescription medication, managing a health condition, or purchasing for a child. Never disregard or delay professional medical advice because of something you have read here. If you think you are having a medical emergency, call your doctor or 911.

Because our products are made from natural botanicals, colour, aroma, taste, and density vary from batch to batch. That variation is normal and is not a defect.

Product descriptions, images, and packaging are provided for identification and may be updated at any time. We try to display colours and details accurately, but we cannot guarantee that your screen renders them exactly. We may change, limit, or discontinue any product at any time without notice. Products may be offered in limited quantities and are subject to availability.

We ship to the continental United States only. We do not ship internationally. Destinations, timescales, and rates are set out in our Ordering and Shipping Policy.

3. Pricing and Payments

All prices are shown in United States dollars and exclude shipping and applicable taxes, which are calculated and displayed at checkout before you pay.

We may change prices, promotions, and discount codes at any time. The price that applies to your order is the price displayed at the moment we accept your order. Discount codes must be entered at checkout and cannot be applied retroactively; only one code may be used per order unless we state otherwise.

Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. Where an error is obvious and could reasonably have been recognised by you as a mispricing, we may cancel the order and refund you in full, even after payment has been taken.

By submitting payment details you represent that you are authorised to use the payment method and you authorise us, and our payment processor, to charge the full order amount, including shipping and tax, to that method. Payment is processed by a third party payment processor; we do not store your full card number.

Your card statement will show this charge as "DDK GROUP, INC.", the registered company behind Divine Medicinals Health Products. If you do not recognise a charge from us, please contact us at contact@divinemedicinals.com or (855) 485-3127 before disputing it with your bank. We can almost always resolve it faster than a dispute can.

You are responsible for any bank or card fees, including declined payment or currency conversion fees, charged by your own financial institution.

4. Orders and Order Acceptance

Placing an order is an offer to buy. It is not an accepted contract. Our order confirmation email acknowledges that we received your order; it does not by itself mean we have accepted it.

A contract is formed only when we accept your order, which we do when we ship it or when we send you a shipping confirmation. Until then we may decline or cancel all or part of your order, for reasons including product unavailability, an error in the price or description, a suspected fraudulent or unauthorised transaction, an address or payment verification we cannot complete, or quantities that suggest resale rather than personal use. If we cancel an order you have already paid for, we refund the amount charged in full.

Please check your order before you submit it. Once an order is submitted we may not be able to change the items, quantities, or shipping address, and orders placed separately cannot be combined. Contact us as soon as possible at contact@divinemedicinals.com if something is wrong and we will help where we still can.

Our products are made in small batches, so orders typically ship within 7 to 21 business days. Shipping timescales, carrier terms, delivery problems, and reshipment are set out in our Ordering and Shipping Policy. Returns and refunds are set out in our Refund Policy.

Risk of loss and title pass to you when we hand the goods to the carrier. That does not limit the rights we give you for lost, damaged, or incorrect deliveries under the Refund Policy.

5. Intellectual Property

The Site and everything on it, including text, product descriptions, photographs, graphics, logos, label artwork, formulations as expressed in our copy, page design, and the selection and arrangement of it all, is owned by DDK Group, Inc. or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

"Divine Medicinals" and "Divine Medicinals Health Products", together with our logos and product names, are our trademarks. You may not use them without our prior written permission.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to view and use the Site for the purpose of shopping with us. You may not copy, reproduce, republish, scrape, sell, licence, distribute, or create derivative works from any part of the Site, or use it to build a competing catalogue or to train a machine learning model, without our prior written permission. This licence ends automatically if you breach these Terms.

If you post a review, photograph, comment, or other content to the Site, you keep ownership of it and you grant us a non-exclusive, worldwide, royalty-free, perpetual, transferable licence to use, reproduce, adapt, publish, and display it in connection with our business. You confirm that the content is yours to give, that it is accurate, and that it does not infringe anyone else's rights. We may remove any submitted content at our discretion.

If you believe material on the Site infringes your copyright, contact us at contact@divinemedicinals.com with enough detail to identify the work and the material in question, and we will respond in accordance with the Digital Millennium Copyright Act.

6. User Conduct and Prohibited Uses

You agree to use the Site lawfully and not to use it in any way that harms us, the Site, or anyone else. In particular, you agree that you will not:

• use the Site for any unlawful purpose, or in breach of any applicable federal, state, or local law or regulation;
• provide false, inaccurate, or misleading information, impersonate anyone, or place an order using a payment method you are not authorised to use;
• buy products for resale, commercial redistribution, or export without our prior written agreement;
• attempt to gain unauthorised access to the Site, any account, or any server or system connected to it, or probe or test its security;
• introduce viruses, malware, or any other harmful code, or interfere with the proper working of the Site;
• use any robot, spider, scraper, or automated means to access, monitor, or copy the Site or its content without our prior written permission;
• use the Site to harass, abuse, defame, threaten, or discriminate against any person, including our staff;
• submit content that is unlawful, obscene, deceptive, or infringing, or that makes medical claims about our products;
• circumvent, remove, or interfere with any security, access control, or usage restriction on the Site;
• misuse a discount code or promotion, including by creating multiple accounts to reuse a single-use offer.

We may investigate any suspected breach and may report unlawful activity to law enforcement. We may refuse service, cancel orders, remove content, and terminate accounts for a breach of this section.

7. Disclaimer of Warranties

To the fullest extent permitted by law, the Site, its content, and the products sold through it are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, timely, secure, or error free, that defects will be corrected, or that the Site or its servers are free of harmful components. We do not warrant that the content on the Site is accurate, complete, current, or reliable, and we may correct it at any time.

We make no warranty that any product will produce any particular result. Individual responses to botanical products vary. As set out in section 2, our products are not intended to diagnose, treat, cure, or prevent any disease, and nothing on the Site is a substitute for professional medical advice.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the exclusions above may not apply to you. In that case they apply to the greatest extent the law permits, and nothing in these Terms excludes liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded.

8. Limitation of Liability

To the fullest extent permitted by law, DDK Group, Inc., its officers, directors, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Site or any product bought through it, whether the claim is in contract, tort, strict liability, or any other theory, and whether or not we were advised that such damages were possible.

Our total aggregate liability to you for all claims arising out of or relating to these Terms, the Site, or any product, will not exceed the greater of the amount you paid us for the product giving rise to the claim, or fifty United States dollars ($50).

Nothing in this section limits your rights under the Refund Policy, and nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limits above may not fully apply to you. In that case our liability is limited to the greatest extent the law permits.

9. Indemnity

You agree to indemnify and hold harmless DDK Group, Inc. and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, your violation of any law, or your infringement of any third party right.

10. Governing Law and Disputes

These Terms and any dispute arising out of them or out of your use of the Site are governed by the laws of the State of Michigan, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Wexford County, Michigan, and waive any objection to that venue.

11. Changes to These Terms

We may update these Terms at any time. The version in force is the one published on this page, and the "Last updated" date at the top shows when it changed. Changes take effect when posted. The Terms that apply to your order are the ones in force at the time you place it. Please review this page from time to time.

12. General

If any provision of these Terms is held unenforceable, the rest remain in force. Our failure to enforce any provision is not a waiver of it. You may not assign your rights under these Terms without our written consent; we may assign ours in connection with a merger, acquisition, or sale of assets. These Terms, together with the Refund Policy, the Privacy Policy, and the Ordering and Shipping Policy, are the entire agreement between you and us about the Site and supersede any earlier understanding.

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, extreme weather, epidemics, labour disputes, carrier failures, supply shortages, and acts of government.
